Terms of Service for Vibe Terminal

1. Introduction

This Terms of Service and End User License Agreement (“Agreement”) is a legal agreement between you (“User”) and isseikz (“Developer”) regarding the use of the mobile application “Vibe Terminal” (“App”). By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement.

2. Grant of License

The Developer grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App for your personal and internal business purposes. The App is provided free of charge.

3. User Responsibilities and Prohibited Uses

3.1 Authorized Access Only:

You agree to use the App only to connect to servers, networks, or systems for which you have explicit authorization.

3.2 Security:

The App operates on a “Local-first” basis. Your credentials and data are stored on your device. You are responsible for securing your device and backing up your data.

3.3 Prohibited Activities:

You agree not to use the App for:

Unauthorized access to any system, network, or data (hacking).
Distributing malware, viruses, or harmful code.
Any activities that violate applicable laws or regulations.
Reverse engineering, decompiling, or disassembling the App.

4. Intellectual Property

The App, including its code, design, and interface, is the intellectual property of the Developer and is protected by copyright laws.

5. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO FITNESS for A PARTICULAR PURPOSE AND NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR THAT IT WILL PREVENT DATA LOSS.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY DAMAGES (INCLUDING LOSS OF DATA, PROFIT, OR SERVER DOWNTIME) ARISING OUT OF YOUR USE OR INABILITY TO USE THE APP, EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. Export Compliance

You agree to comply with all applicable export control laws, including the U.S. Export Administration Regulations (EAR). You represent that you are not located in a prohibited country or on a prohibited person list.

8. Governing Law and Jurisdiction

This Agreement shall be governed by the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court.

利用規約

1. はじめに

本利用規約（以下「本契約」）は、ユーザーと isseikz（以下「開発者」）との間の、アプリ「Vibe Terminal」（以下「本アプリ」）の利用に関する法的合意です。本アプリを利用することで、ユーザーは本契約に同意したものとみなされます。

2. ライセンスの付与

開発者はユーザーに対し、個人的および社内業務目的で本アプリを使用するための非独占的なライセンスを付与します。本アプリは無料で提供されます。

3. ユーザーの責任と禁止事項

3.1 権限のあるアクセス:

ユーザーは、自身がアクセス権限を持つサーバーやネットワークに対してのみ本アプリを使用することに同意します。

3.2 セキュリティ:

本アプリは端末内で完結して動作します。認証情報やデータの管理責任はユーザーにあります。

3.3 禁止行為:

以下の行為を禁止します。

不正アクセス行為（ハッキング）。
マルウェアやウイルスの配布。
法令に違反する行為。
アプリの解析、逆コンパイル、リバースエンジニアリング。

4. 知的財産権

本アプリのコード、デザイン、権利は開発者に帰属し、著作権法で保護されています。

5. 保証の否認（免責）

本アプリは「現状有姿」で提供され、いかなる保証もありません。 開発者は、本アプリが特定の目的に適合すること、エラーがないこと、データ損失が発生しないことを保証しません。

6. 責任の制限

法律で認められる範囲において、開発者は本アプリの使用に起因するいかなる損害（データ消失、サーバー停止、利益損失など）についても責任を負いません。

7. 輸出管理

ユーザーは、米国の輸出管理規則（EAR）を含む関連法規を遵守することに同意します。

8. 準拠法と管轄

本契約は日本法に準拠し、東京地方裁判所を第一審の専属的合意管轄裁判所とします。
